ANSWER: The Fourth of July is right around the corner, and with it brings the anticipation of epic firework shows. While many Florida residents are eager to perform their own red, white, and blue extravaganzas, doing so without any thought to Florida laws could set you up for some serious legal trouble. Only certain fireworks are legal in Florida, so it is important to know which ones make the cut. State law maintains that only sparklers are allowed for consumer use. There are a number
of different fireworks that fall under this category, including:

  • Smoke and punk
  • Fountains
  • Novelties
  • Crackle and Strobe
  • Wheels and Spinners
  • Snakes

Any exploding fireworks are considered illegal unless you are a legally approved user. Just because you sign a waiver in order to purchase fireworks does not mean you are an approved user. You
will face harsh penalties as a result. If you are caught illegally using fireworks, you can be charged with a first-degree misdemeanor, resulting in up to one year in jail and a $1,000 fine. Although it is easy to get caught up in the festivities, lighting off fireworks “just because everyone else is doing it” is never a good excuse. Your main priority should be to have a fun and safe Independence Day while avoiding any legal misfortune.

  • Use sparklers and other approved novelties on a flat, hard surface
  • Only use sparklers in an open area, away from children
  • Purchase fireworks from licensed and approved vendors
  • Keep a bucket of water or fire extinguisher nearby at all times
  • Keep young children away from all fireworks and implement adult supervision.
  • Never carry sparklers in your pocket or shoot them off in metal or glass containers.
